Summary Judgment Granted in Federal Court Against Plaintiff Who Claimed 10 Counts of Alleged Wrongdoing by his Employer on the Basis of Disability

Summary Judgment was granted in federal court in favor of a public entity employer against a plaintiff who alleged 10 counts of discrimination, harassment, retaliation, and failure to prevent  such wrongdoing, on the basis of a physical disability, in violation of the Americans with Disabilities Act, and the Fair Employment and Housing Act.  Plaintiff also alleged failure to make reasonable disability accommodations, and failure to engage in the interactive process under the Fair Employment and Housing Act.  The Court found that the employer presented an overwhelming amount of legitimate, nondiscriminatory evidence to justify any alleged adverse employment actions.  The Court further held that the employer successfully demonstrated that it took all proper steps to accommodate the requests for accommodations and to engage in the interactive process.
