District Not Liable For Daughter’s Truancy And Mother’s Arrest

In a case where the plaintiff alleged she was wrongfully arrested for her daughter’s truancy as a result of a school district’s negligence, a Demurrer was filed on grounds that (1) the plaintiff’s case was barred by the statute of limitations; and (2) the plaintiff had failed to file a Claim pursuant to the Government Tort Claims Act.  The trial court sustained the Demurrer without leave to amend and dismissed the plaintiff’s case.  The plaintiff appealed, and the Court of Appeal affirmed the trial court’s ruling.
